The Szolnok District Court found the defendant called M. Z. guilty in the felony of assault on a public official and in the misdemeanour of battery, therefore, as a cumulative sentence, imposed a 2 years 8 months long imprisonment penalty on him and deprived him of his civil rights for 4 years. In its decision delivered on 30 June 2015, the Szolnok Regional Court as the second instance court essentially upheld the first instance judgement.

As it was established in the facts of the case, on 1 August 2012 the defendant was treated in the Emergency Department of the County Hospital. The defendant decided to leave the hospital at his own risk. The victim, who was on patient transport duties, walked the defendant up to the door of the hospital. On their way the defendant kept picking on and swearing at the victim, made obscene comments about him, to all of which the victim did not respond. The defendant left the territory of the hospital by climbing over its fence, while the victim started to walk back towards the building. But shortly afterwards the defendant jumped back over the fence into the territory of the hospital, followed the victim and kicked him with his right leg at the victim’s left knee, then unsuccessfully tried to hit the victim on his head on several occasions, while the victim was protecting himself with his hands. The defendant was held down by two hospital employees rushing to the help of the victim. As a result of the defendant’s abuse the victim suffered the bruise of his left knee, which takes less than eight days to heal, and for which the victim submitted a private motion with legal effect against the defendant.
