On its session of the 8th April, 2014 the National Council for the Judiciary discussed the operative regulations of section 1, point e) of the 103 paragraph of the Act on the Organisation and Administration of Courts that ordered to its jurisdiction the timely tasks regarding the approval of the Ethical Codex of Judges.

 

This March, the National Council for the Judiciary, paralelly with the Hungarian Assiciation of Judges turned to the judges with a questionnaire in the interest of the promotion of a consense created by the largest possible basis of the most important principles of an ethical codex.

On the session of the 8th of April, the first evaluation of the questionnaires took place, and also a vivid colloquy evolved regarding the further directions of the work.

The National Council for the Judiciary, in its decision, ordered to its Coordinational Commission estabilished for the goal to create an ethical codex, to work out the most important principles for judges, letting still open the problem if they want to penalise the infringement of the ethical norms and how should they do it.

 

Besides the aforementioned, the National Council for the Judiciary has listened to the report of Mr. Péter Baur, president of the Appeal Court of Gyula, who is also the president of the administrative part-work group created by the president of the National Judicial Office, on the activity of the work group. Afterwards, Mr. Lajos Makai, president of the Regional Court of Appeal of Pécs, being also the president of the Hungarian Association of Judges, gave information on the accomplished work of the Association regarding the elaboration of the judicial life career model. The Council has listened to the reference of the head of the Control Department of the National Judicial Office regarding its controlling activity in 2013.

 

The president of the the National Council for the Judiciary has reported to the members on the session of the work group of the judicial councils of the Balkan and Euro-Mediterranean esplanade that took place this March in Hungary. The National Council for the Judiciary has accepted the report and it has nominated the persons that will be delegated to the next conference in Bukarest, between the 12th -13th of May, 2014.

 

The president of the National Judicial Office has informed the National Council for the Judiciary about her proposal on the amendment of the 7/2011. (III.4.) decree of the Ministry of Public Administration and Justice on the detailed regulations of judging the applications for the position of judge and the points that can be given during the creation of a rank of the candidates. Even if the conceptions regarding the amendment of the decree were previously discussed both by the Hungarian Association of Judges and by the National Council for the Judiciary, the Council has accepted in great part the partially different conception of the president of the National Judicial Office. The draft for the amendment of the decree builds on the experiences gained during the enforcement. Its main aim is to promote the most objective and transparent judgement of the applications for the positions of judge.
