The National Judicial Council has made a decision on the principles to be taken into account during the evaluation of the applications for judicial posts - 21. January 2013.

The amendment of the law on the organisation of the judiciary entered into force in July 2012 has extended the competencies of the NJC in several fields. According to the amendment the Council is obliged to elaborate principles  the president of the National Office for the Judiciary and the president of the Curia shall respect when making a proposal on deviating from the ranking of the Judges' Council of the respective courts upon evaluating the applications for judicial posts. On 21 January 2013 the NJC determined therse principles in its Decision No. 3/2013 (I.21.) The Council emphasised that the ranking set up by the Judges' Councils of the Curia, the regional courts of appeal and the regional courts shall be the primary aspect (Principle of the primacy of the ranking).

The following eight principles shall be applied when deviating from the main principle:

  1. Principle of discretion
  2. Principle of equal assessment
  3. Principle of avoiding the incompatibility
  4. Principle of the interest of the judiciary
    • Principle of the efficient management of cases
    • Principle of the special professional requirements
    • Principle of the permanent performance of tasks
  1. Principle of defending the judicial career
  2. Principle of evaluating the previous work performance of the applicant
  3. Principle of the contentual evaluation of the score achieved in the application procedure
  4. Principle of exclusiuon of the derivation
