Debrecen Court of Appeal – sexual assault

The council lead by Lajos Balla Dr. at the Debrecen Court of Appeal validated the first-instance verdict.

About the case

Proceeding at first instance, in March 2015 the Tribunal of Miskolc sentenced the accused, Gy. L. to 10 years in maximum security prison and prohibited him from practicing public affairs for 10 years because of continuously committed felony sexual assault. The accused can be released earliest on probation after completing ¾ of his sentence. He and his defender appealed for mitigation.

Statistical data on defendants of closed criminal cases

The National Office for the Judiciary collects and then processes data regarding juvenile or adult defendants who were convicted under Government decree 388/2017 (XII. 13.) on the mandatory data service for the National Statistical Data Collection Program. The collected data are not only used for domestic research but to provide information in case of international inquiries as well. The statistics also provide an overview of the main social, sociological, and criminal indicators regarding defendants and the issued punishments.

The president of the NOJ welcomed the minister of justice of the Czech Republic

At the meeting, György Senyei emphasized that the Czech Republic and Hungary are linked not only by their geographical proximity and common history, but also by the Roman and Continental legal roots of the two legal systems, as well as the simultaneous change of regime and accession to the European Union.

The appointment of court leaders is for 6 years, except in the case of appointment as president of a chamber for an indefinite term. Court leader offices can only be held by judges appointed for an indefinite term.

Hungary at the forefront of Europe based on the timeliness of judgments

At its meeting on 5 June 2019, the Committee of Ministers of the CE, which oversees the implementation of the judgments of the European Court of Human Rights (ECHR) of Strasbourg, discussed the Hungarian steps taken to implement the Gazsó-judgment related to the length of procedures.

Criminal proceedings

The objective of criminal proceedings are to make a decision about the criminal responsibility of a person who committed a crime. In Hungary only a court can establish guilt/criminality and impose a sentence on a person.

In case of a suspicion that a crime was committed, the proceedings are started either ex officio or by bringing a charge against somebody. Such charge may be brought by either the victim of the crime, or anybody becoming aware of such crime. The report must be made to the police.
